AIRXFER, a Mobile Air-Time Recharge service (hereinafter referred to as the "Service") is made available to you by Spice i2i Limited, a company incorporated in the Republic of Singapore (hereinafter "Spice i2i").
This Service allows you to purchase and recharge air-time minutes for prepaid mobile phones of the intended users (hereinafter referred to as the "Recipient").

By using the Service, you agree to be bound by these Terms and Conditions; if you do not wish to be bound by these terms and conditions, you may not access or use the Service.

Spice i2i reserves the right to modify these Terms and Conditions at any time with immediate effect upon posting such modification on this website. By selecting "accept" below, you accept these Terms and Conditions, you agree to review these Terms and Conditions periodically, and also agree that your continued use of the Service shall be deemed your acceptance of the modified Terms and Conditions.

CONDITIONS ON USE OF THE SERVICE

  • MUST BE OF LEGAL AGE. In your country of residence you must be at least of legal age to use the Service.
  • USE OF SERVICE. You may use the Service to purchase a top-up as follows: (i) Use and follow the step-by-step transaction process to initiate a recharge; (ii) After you place the order and the transaction is successfully processed, the Recipient will be informed that his or her pre-paid mobile account has received a top-up. However, due to the unguaranteed delivery for SMS, the Recipient may or may not receive the SMS; (iii) The Recipient’s pre-paid mobile account will receive the recharge 15-30 minutes after the purchase transaction is completed.
  • ALL SALES ARE FINAL. Once a top-up or recharge is ordered and accepted, there can be no cancellation of the order. For most transactions, the payment is processed almost immediately after submission of order. Accordingly, all sales transactions are final and non-refundable.
  • PROBLEMS WITH THE SERVICE. If you encounter a problem with the Service or have any questions relating to your recharge/top-up transaction, you can contact Airxfer at support@airxfer.com

MOBILE OPERATOR'S SERVICE TAX AND FEES, TERMS AND CONDITIONS

Airxfer.com is not your or the Recipient’s telecommunications services provider. The telecommunications services that the mobile network operator provides are separate from the Service that Spice i2i is providing you in accordance with these Terms and Conditions. Spice i2i, is only offering you a convenient service through which you can add a top-up /recharge to Recipients as described above in the Conditions on Use of the Service. Accordingly, Spice i2i has no responsibility for any telecommunications services, goods, other services, information, software or other materials relating to any mobile operator or relating to the specific service plan or mobile subscriber agreement between the mobile operator and the Recipient.

  • MOBILE OPERATOR’S TERMS AND CONDITIONS. Spice i2i strongly recommends that you either (i) review the mobile operator’s terms and conditions offered by the respective mobile operators or (ii) check with the Recipient before using Airxfer.com, as the terms and conditions pertaining to the use of top-up/recharge will be governed by the respective mobile operator’s terms and conditions and not any agreement between you and Spice i2i.

  • FEES AND TAXES.
    (i) Additional deductions and charges from the face value of the top-up/recharge are likely to apply, including surcharges, taxes, fees and other similar charges that are imposed by the mobile operator or imposed in the jurisdiction in which the Recipient’s mobile phone is registered. Spice i2i does not control any deductions the mobile operator may add to the transaction, as these deductions may change at any time at the mobile operator’s discretion.
    For example: Recipients in India and Pakistan will be subject to a deduction of up to 15% of the face value by their respective Mobile Network Operators. The credit that will be received by Recipients in India and Pakistan will be at least 85% of the face value.
    Note: The top-up/recharge credit displayed represents the face value of credits that will be transferred to the Recipient by Airxfer.com

    (ii) Spice i2i charges a convenience fee for transactions made through the Service. At the time of purchase, Spice i2i will provide the purchaser with an estimated amount of minutes that the Recipient will be credited with through the selected top-up/recharge package. The cost for this package includes all fees or charges from Spice i2i or the mobile operator. The Recipient may also receive more credits than stated at the time of purchase, depending on deductions and fees imposed by the mobile operator, but in no instance will receive any less than was initially stated at the time of purchase.

    (iii) Top-ups/recharges will generally have an expiration date, which is established by the mobile operator. The minutes provided through these top-up/recharge transactions will be valid for a minimum of thirty (30) days, but maybe valid for longer periods depending upon the specific mobile operator. Please consult your Recipient’s mobile operator for additional details.

COLLECTION AND SHARING OF INFORMATION

Spice i2i will not sell, rent or provide your or the Recipient’s personal information (mobile telephone number) to third parties for their own marketing purposes without your consent, other than for the purpose of fulfilling the top-up/recharge transaction. However, Spice i2i will not be responsible if the Recipient’s mobile operator chooses to use your information for their own purposes or chooses to sell or rent or provide your information to other parties.

REFUND POLICY

No refunds shall be made by Spice i2i for the purchases under the following circumstances:

  • You mistakenly enter a wrong mobile number for the Recipient;
  • You purchase a wrong package/denomination;
  • You allege that the Recipient did not receive the top-up/recharge, but upon investigation done by the air-time provider with the mobile operator, the mobile operator verifies that the Recipient’s mobile number has indeed been topped-up/recharged with the air-time denomination/package purchased; and
  • You allege that the Recipient’s mobile number is not topped-up/recharged with the exact purchased denomination. (please refer to FEES and TAXES above)

Spice i2i will grant refunds under the following circumstances:
  • You allege that the Recipient did not receive the top-up/recharge but upon investigation it is found that the mobile operator has verified that the top-up/recharge failed due to a transient outage but a successful status is returned which triggered a deduction of the user’s account for the purchase.
SUSPENSION OR TERMINATION OF SERVICE

Spice i2i can suspend, terminate or block any user from using the Service if the user is deemed to have misused the Service and Spice i2i’s decision on this shall be final.

MISCELLANEOUS

The above Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. In the event of any dispute, you and Spice i2i agree to submit to the exclusive jurisdiction of the courts of Singapore. If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the original intentions of the parties, with the other provisions remaining in full force and effect.

Spice i2i’s failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Spice i2i in writing. No waiver of breach or of any right or remedy contained in or granted by this Agreement will be effective unless it is in writing and signed by the party waiving the breach, right, or remedy, nor shall any waiver constitute a continuing waiver unless the writing so specifies.

You and Spice i2i agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action arose, otherwise such cause of action is permanently barred.

The section titles in these Terms and Conditions are solely for the convenience of the parties and have no legal or contractual significance.
